These Terms and Conditions (“Agreement”) govern your use of the PharmXHealthOne website located at www.pharmxhealthone.com, purchases made through the site, and services rendered at any PharmXHealthOne clinic or affiliated provider. By using our website or receiving in-person services, you accept and agree to be bound by the terms set forth herein.

If you do not agree to these terms, you must immediately discontinue use of the website and refrain from receiving any further services or making purchases through PharmXHealthOne.

2. Eligibility

To receive medical treatment or purchase any products through PharmXHealthOne, you must be at least 18 years of age or be legally authorized by a parent or guardian. You affirm that all information provided to us is truthful and current. You agree not to impersonate another person or misrepresent your identity for the purpose of obtaining treatment or products.

3. Medical Disclaimer

All treatments, medications, therapies, and health services offered by PharmXHealthOne are provided only upon proper medical evaluation and provider approval. Individual results vary and no guarantees of outcome are expressed or implied. Information presented on our website is for informational purposes only and does not constitute medical advice.

Purchasing a product online does not establish a physician-patient relationship unless you are medically evaluated and approved for treatment. PharmXHealthOne reserves the right to decline or modify any order based on provider discretion, regulatory compliance, or medical contraindications.

4. Consent to Treatment and Risk Acknowledgment

By accepting treatment from PharmXHealthOne, either in person or via telehealth, you confirm that you have read and signed our Consent to Treat & Financial Responsibility Agreement, which outlines the risks, benefits, and limitations of the services provided. You understand that some therapies may be compounded, customized, or used off-label, and may not be FDA-approved for your specific condition.

You agree to disclose all medical history, allergies, and medications prior to receiving treatment. Failure to do so may increase your risk of adverse outcomes and is solely your responsibility.

5. Telehealth Consent

If you receive services via telehealth, you acknowledge that telemedicine has limitations and may not fully replace in-person medical evaluations. You agree to comply with all security, location, and technical requirements outlined in our Telehealth Consent and that your participation is voluntary under Florida Statutes § 456.47.

6. Purchasing Terms (Online & In-Clinic)

All product purchases, including medications, peptide therapies, hormone treatments, supplements, and diagnostic lab orders, are final sale and non-refundable. Due to legal restrictions and patient safety protocols, we cannot accept returns of prescription products or medical therapies, whether opened or unopened.

Orders placed through www.pharmxhealthone.com may require telehealth or in-person evaluation before fulfillment. If you are medically ineligible for a product you’ve purchased, we will contact you to discuss alternative options. PharmXHealthOne reserves the right to decline fulfillment based on clinical judgment, regulatory requirements, or availability.

7. Subscription Services and Cancellation Policy

Subscriptions are auto-renewed on a monthly basis unless canceled in writing via email to health@pharmxhealthone.com at least 72 hours prior to the next billing cycle. Once billed, subscription fees are non-refundable. It is your responsibility to manage and monitor your subscription status through your online account.

8. No Emergency Services

PharmXHealthOne does not provide emergency medical services. If you are experiencing a medical emergency, you must dial 911 or seek immediate care at an emergency room. Our services are elective and do not replace primary care or emergency medicine.

9. Limitation of Liability

To the maximum extent permitted under Florida law, PharmXHealthOne and its physicians, affiliates, employees, contractors, or representatives shall not be held liable for any indirect, incidental, special, consequential, or punitive damages arising from use of our website, products, or services. All services and products are provided “as-is” and “as available.”

This limitation includes but is not limited to claims of personal injury, dissatisfaction, adverse reaction, treatment ineffectiveness, or any consequence arising from delayed or misused information.

10. Indemnification

You agree to indemnify, defend, and hold harmless PharmXHealthOne, its affiliates, and staff against any claims, losses, or liabilities (including attorney’s fees) resulting from your breach of these Terms, unauthorized use of the website or services, false health disclosures, or violation of any law or regulation.

11. Dispute Resolution, Mediation & Arbitration

All disputes exceeding small claims limits will be subject to binding arbitration, in accordance with Florida Statutes § 766.207 and the Federal Arbitration Act. Prior to arbitration, both parties agree to engage in good-faith mediation in Palm Beach County, Florida. Any litigation permitted outside arbitration must be filed exclusively in the courts of Palm Beach County, Florida.

By accepting these Terms, you waive your right to a jury trial in any dispute with PharmXHealthOne.

12. Governing Law

This Agreement shall be governed by and interpreted under the laws of the State of Florida, without regard to its conflict of law principles. Any legal action not subject to arbitration must be brought in a court of competent jurisdiction in Palm Beach County, Florida.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable by law, the remaining provisions shall remain in full force and effect.

14. Modifications to Terms

PharmXHealthOne reserves the right to modify these Terms and Conditions at any time without prior notice. The most current version will always be posted on our website. Continued use of our services or website constitutes acceptance of the updated terms.
