At PharmXHealthOne, we are committed to protecting the privacy, confidentiality, and security of your personal and health information. As a licensed healthcare provider in the State of Florida, we operate in full compliance with the Health Insurance Portability and Accountability Act of 1996 (HIPAA), the Florida Information Protection Act (FIPA), Fla. Stat. § 501.171, and the Florida Patient’s Bill of Rights and Responsibilities, Fla. Stat. § 381.026. We also comply with all applicable rules set by the Florida Department of Health, the Agency for Health Care Administration (AHCA), and federal data privacy laws governing healthcare and telehealth services.

This Privacy Statement outlines how we collect, use, protect, and share your information when you engage with us either online at www.pharmxhealthone.com, through our mobile applications, or during in-person visits at any of our clinic locations. By accessing our services, you acknowledge that you have read and agree to the practices described herein.

 

1. Legal Obligations and Patient Consent

Under Florida Statutes § 456.057 and HIPAA, we are legally required to safeguard your Protected Health Information (PHI) and to inform you of our privacy practices. We are also required to obtain your consent before using or disclosing your information for treatment, payment, or healthcare operations unless otherwise permitted or required by law. Any unauthorized use or disclosure of your PHI is prohibited unless you have provided explicit written authorization or unless such use is necessary to comply with a court order, a public health requirement, or a regulatory investigation as defined under Fla. Stat. § 395.3025.

 

2. Information We Collect

We collect and maintain different categories of information, including personal, medical, commercial, and electronic data. Information you voluntarily provide includes your name, contact details, date of birth, insurance and payment information, medical history, medication lists, appointment preferences, and any other data submitted through forms, portals, or verbal communication.

In addition, we may collect information automatically through our websites or mobile applications, such as your device IP address, browser type, usage behavior, location data, and interactions with our platforms. We also collect information from third-party sources such as payment processors, electronic health record systems, and marketing partners, where legally permissible.

If you use our telehealth services, we may gather diagnostic data, prescription preferences, and additional digital interactions as part of your electronic medical record. For patients visiting our clinics, we may also record video surveillance for security and quality assurance purposes, consistent with Fla. Stat. § 501.171(5)(a) regarding data collected in the normal course of operations.

 

3. How Your Information Is Used

We use your information to provide, coordinate, and manage your medical care. This includes evaluating your eligibility for treatments, creating and maintaining your care plan, processing your transactions, and delivering services such as hormone therapy, peptide therapy, weight loss programs, diagnostic tests, IV therapy, and telemedicine consultations. Your information also enables us to schedule appointments, verify identity, submit insurance claims where applicable, and document required communications with you in accordance with Fla. Stat. § 381.026(4).

We also use your information for business administration, record retention, legal compliance, quality improvement, and to personalize your patient experience. With your consent, we may use your contact information to send appointment reminders, special promotions, service updates, and newsletters.

We do not use or disclose your PHI for marketing purposes without your explicit authorization. We may use anonymized, aggregated information for internal analytics, service optimization, or operational planning.

 

4. Data Sharing and Third Parties

Your information is shared only as necessary to fulfill healthcare, operational, or legal requirements. In accordance with Fla. Stat. § 456.057(7)(a), PharmXHealthOne may share your PHI with third-party providers or business associates who support our operations, such as laboratories, electronic medical record vendors (e.g., AdvancedMD), and payment processors (e.g., Clover and First Data).

We take appropriate contractual and technical steps to ensure that our business associates protect your PHI with the same level of confidentiality required under HIPAA and Florida law. We may also disclose information as required by law, including for public health reporting, investigations, subpoenas, or mandatory audits by regulatory agencies.

Your personal or medical data is never sold. We do not disclose identifiable patient information for commercial gain, and any marketing-related data sharing—such as demographic patterns, appointment preferences, or feedback—occurs only in aggregate and never includes PHI unless you have provided written consent.

 

5. Security and Retention of Data

PharmXHealthOne employs physical, technical, and administrative safeguards to prevent unauthorized access to your information. These measures include data encryption, secure socket layer (SSL) technology, restricted access protocols, password protection, and role-based access to electronic health records.

We retain your medical and personal records in accordance with Fla. Stat. § 456.057(13), which requires medical records be preserved for at least five (5) years after the last patient contact. When no longer legally required, your data is securely destroyed or anonymized per HIPAA guidelines and Fla. Stat. § 501.171(8) regarding secure disposal.

 

6. Telehealth Services and Patient Responsibility

Telehealth consultations are governed by Fla. Stat. § 456.47, which sets standards for virtual medical care in the state. If you engage in telemedicine services through our website or mobile app, you must ensure that you are in a private, secure location and that your device meets the minimum security requirements.

You are responsible for maintaining the confidentiality of your access credentials and for notifying us immediately in the event of a breach or suspected unauthorized access. While we take precautions to secure data transmitted during telehealth sessions, you acknowledge that no internet-based platform is entirely immune from breaches or technical disruptions.

 

7. Your Rights Under Florida and Federal Law

As a patient, you have the right to request access to your health records, to request an amendment of incorrect data, and to obtain an accounting of disclosures made. You may also request restrictions on the use or disclosure of your PHI, and you may opt out of certain communications. We will respond within the timeframes established under HIPAA and Fla. Stat. § 381.026(4)(b), and we may charge a reasonable fee for the reproduction of records as permitted by Fla. Stat. § 456.057(12).

 

8. Children’s Privacy

Our services are intended for adults and are not directed to children under the age of 13. In compliance with Fla. Stat. § 1002.222 and the federal Children’s Online Privacy Protection Act (COPPA), we do not knowingly collect personal data from minors without verifiable parental consent. If we discover that we have received data from a child without appropriate authorization, we will promptly delete such information.

 

9. Policy Updates and Contact Information

This Privacy Statement may be updated periodically to reflect changes in legal requirements, technology, or operational practices. The revised version will be published on our website with the updated "Effective Date." You are encouraged to review this statement regularly.
